1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Funny Joker Gaming ("we," "us," or "our"), operating at funnyjokergaming.com. By accessing, registering on, or using any part of the Funny Joker Gaming platform, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
If you are accessing the platform on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms, and that the organisation agrees to be bound. If you do not have such authority, or if you do not agree to any provision of these Terms, you must not use the platform.
These Terms should be read together with our Privacy Policy and our Cookie Policy, which are incorporated by reference. In the event of any conflict between these documents, these Terms take precedence with respect to your rights and obligations as a user.
We may revise these Terms from time to time. Notice of material changes will be provided via email (if you have an account) and via a prominent banner on the website at least 14 days before the changes take effect. Your continued use after the effective date of any revision constitutes acceptance of the updated Terms.
2. Description of Service
Funny Joker Gaming provides a free, browser-based social arcade entertainment platform. Our current offering includes Joker's Flame Arena and may expand to include additional joker-themed interactive experiences over time. The platform is designed for entertainment and social engagement purposes only.
Key characteristics of the service:
- Completely free: All games and platform features are provided free of charge. There is no subscription fee, no in-app purchase mechanism, and no paywall of any kind.
- No monetary stakes: No real currency, cryptocurrency, or asset of monetary value is wagered, won, or lost through the platform at any point.
- Social features: The platform may include leaderboards, community hubs, chat functionality, and profile customisation to enhance the social dimension of play.
- Canada-only: The service is intended for residents of Canada. Access from outside Canada is not prohibited, but the platform is designed, regulated, and operated with Canadian audiences in mind.
We reserve the right to modify, suspend, or discontinue any feature, game, or portion of the service at any time, with or without notice. We will not be liable to you for any such modification, suspension, or discontinuation.
3. Eligibility
To use Funny Joker Gaming, you must meet all of the following eligibility requirements at all times:
- You must be at least 19 years of age. The minimum age reflects the majority age in most Canadian provinces and territories; in Quebec the age of majority is 18, however we have adopted a uniform national minimum of 19 to ensure consistent protection.
- You must be a resident of, or accessing the platform from, Canada.
- You must have the legal capacity to enter into a binding agreement under applicable law.
- You must not be subject to a court order or legal restriction prohibiting access to entertainment platforms of this nature.
- Your account must not have been previously suspended or permanently banned by Funny Joker Gaming for a violation of these Terms.
By using the platform, you represent and warrant that you satisfy all of the eligibility criteria above. If we discover that a user does not meet these requirements, we reserve the right to suspend or terminate their account immediately and without notice.
4. Account Registration
While some portions of the platform may be accessible without registration, certain features — including saving progress, accessing leaderboards, and participating in community features — require you to create a free account.
When creating an account, you agree to:
- Provide accurate, current, and complete information during registration and keep it up to date.
- Choose a display name that is not offensive, impersonating, or violating the rights of any third party.
- Keep your login credentials confidential and not share them with any other person.
- Notify us immediately at hello@funnyjokergaming.com if you suspect unauthorised access to your account.
- Be solely responsible for all activity that occurs under your account, whether or not authorised by you.
We reserve the right to refuse registration, or to suspend or terminate an existing account, at our sole discretion, with or without providing a reason, provided we act in accordance with applicable law. We will generally provide a reason and an opportunity to respond before taking permanent action unless doing so would compromise platform security or the safety of other users.
5. Acceptable Use
You agree to use the platform only for its intended purpose of lawful, personal, non-commercial social entertainment. The following behaviours are strictly prohibited:
- Circumventing, disabling, or interfering with any security feature, age-verification system, or access control on the platform.
- Using bots, scripts, macros, or automated tools to interact with the platform in any way, including for the purpose of achieving artificially high scores or flooding community features.
- Uploading, posting, or transmitting any content that is unlawful, threatening, harassing, abusive, defamatory, pornographic, or otherwise objectionable.
- Impersonating another user, member of our team, or any third party.
- Reverse-engineering, decompiling, disassembling, or otherwise attempting to derive source code from any part of the platform.
- Attempting to gain unauthorised access to any server, database, or system associated with Funny Joker Gaming.
- Transmitting viruses, malware, or any other malicious or disruptive code.
- Using the platform in any manner that could damage, overburden, or impair our servers or networks.
- Collecting or harvesting user data from the platform without express written permission.
- Using the platform for commercial purposes, advertising, or spam without our prior written consent.
Violations of this section may result in immediate account suspension or termination, and may be reported to relevant law enforcement authorities where required by law.
6. Intellectual Property
All content on the Funny Joker Gaming platform — including but not limited to game artwork, animations, audio, interface design, text, logos, branding, and software code — is owned by or licensed to Funny Joker Gaming and is protected by Canadian and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the platform for personal, non-commercial entertainment purposes only. This licence does not include:
- Any resale or commercial use of any platform content.
- The right to download, copy, reproduce, or distribute any platform content except as expressly permitted.
- Any use of data mining, scraping, or similar data extraction methods.
- Creation of derivative works based on any platform content.
Any rights not expressly granted in these Terms are reserved by Funny Joker Gaming. Unauthorised use of platform content may constitute copyright infringement or trademark infringement and could expose you to civil and criminal liability.
7. User Content
If you submit, post, or otherwise make available any content through the platform's community or social features — including usernames, profile images, chat messages, forum posts, or feedback — you retain ownership of that content, but you grant Funny Joker Gaming a worldwide, royalty-free, non-exclusive, perpetual licence to use, reproduce, modify, adapt, publish, and display such content for the purpose of operating, improving, and promoting the platform.
You represent and warrant that any content you submit: (a) does not infringe any third-party intellectual property rights; (b) does not contain personal information about any third party without their consent; (c) complies with these Terms and all applicable laws; and (d) is not harmful, defamatory, or otherwise objectionable.
We reserve the right (but not the obligation) to monitor, edit, or remove user-submitted content at our discretion, particularly where it violates these Terms or our Community Guidelines.
8. No Monetary Value
Virtual items, points, scores, badges, achievements, and any other in-platform elements (collectively "Virtual Items") have no monetary value and cannot be exchanged, transferred, or redeemed for cash, cash equivalents, or any goods or services of tangible value — either on or off the platform.
Funny Joker Gaming does not operate any mechanism for the exchange of real-world currency for Virtual Items, nor for the conversion of Virtual Items back into currency. The platform is purely a free social entertainment experience. There is no opportunity to win, lose, earn, or otherwise acquire anything of monetary value through participation in any activity on this platform.
Virtual Items are granted under licence and may be modified, adjusted, or removed by Funny Joker Gaming at any time without compensation or prior notice. Users have no property rights in Virtual Items.
9. Disclaimers
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.
We do not warrant that: (a) the platform will be uninterrupted, error-free, or free of viruses or other harmful components; (b) the results obtained from use of the platform will meet your expectations; or (c) defects in the platform will be corrected. Scheduled maintenance may result in temporary periods of unavailability; we will endeavour to provide advance notice of planned downtime.
Nothing in these Terms limits or excludes any guarantee, condition, or warranty implied by statute that cannot lawfully be excluded, including any applicable consumer protection rights under Ontario's Consumer Protection Act, 2002 or the federal Canada Consumer Product Safety Act.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Funny Joker Gaming and its officers, directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with your use of, or inability to use, the platform, regardless of the theory of liability and even if we have been advised of the possibility of such damages.
Our aggregate total liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount, if any, you have paid to us in the 12 months preceding the claim (which, given our entirely free service, is likely zero), or (b) CAD $100.00.
Some jurisdictions do not allow the exclusion or limitation of certain categories of damages. In such cases, our liability will be limited to the maximum extent permitted by applicable law.
11. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict-of-laws principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the platform that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of Ontario, Canada. You irrevocably submit to the personal jurisdiction of those courts and waive any objection to proceedings in those courts on the grounds of inconvenient forum.
Informal Resolution. Before initiating any formal legal proceeding, you agree to contact us at legal@funnyjokergaming.com with a written description of your dispute and your desired resolution. We will attempt in good faith to resolve the dispute informally within 30 days of receiving your notice. This informal resolution requirement does not apply to intellectual property infringement claims or emergency injunctive relief.
12. Modifications & Termination
We reserve the right to modify these Terms at any time. Material changes will be communicated with at least 14 days' notice before taking effect, via email and/or a prominent notice on the platform. Non-material changes (such as typographical corrections or clarifications that do not affect your rights) may take effect immediately.
We may suspend or terminate your access to the platform at any time, with or without cause or notice, though we will generally provide written notice and a reason for termination. Upon termination, your licence to use the platform ceases immediately, and we may delete your account and all associated data in accordance with our Privacy Policy retention schedule.
You may terminate your account at any time by contacting us at hello@funnyjokergaming.com with a request for account deletion. All provisions of these Terms that by their nature should survive termination — including ownership provisions, warranty disclaimers, indemnification, and limitations of liability — shall survive.
